Terms of Service

These Terms of Service ("Terms") govern your access to and use of Unquittable Pulse (the "Service"), operated by Unquittable Church ("Unquittable Church", "we", "us", or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.

1. The Service

Unquittable Pulse provides tools for church leaders to gather anonymous congregation pulse surveys and view resulting dashboards, trends, and AI-generated insights. Members respond anonymously and are not required to create an account.

2. Acceptance

By continuing to access or use the Service, you agree to be bound by these Terms and by our Privacy Notice. If you do not agree, please do not use the Service.

3. Accounts and eligibility

Leaders must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be of legal age to form a binding contract to subscribe.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• send spam or attempt to manipulate survey results;
• infringe the intellectual property or privacy rights of others, or upload content you do not have the right to share;
• interfere with or compromise the security or integrity of the Service, including introducing malware, probing, scanning, or scraping;
• attempt to re-identify anonymous respondents or otherwise undermine the anonymity the Service is designed to protect.

5. Intellectual property

Unquittable Church retains all ownership of the Service and its underlying software, documentation, content, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not reverse engineer, resell, or redistribute the Service or circumvent its technical limits.

6. Subscriptions, payment, and billing

Paid subscriptions are billed on a recurring basis as described at checkout and on our Pricing page. Subscriptions include a 30-day free trial; unless you cancel before the trial ends, your subscription will begin and your payment method will be charged the then-current fee. Subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are also governed by Paddle's Buyer Terms. Refunds are described in our Refund Policy.

7. Service availability

We work hard to keep the Service reliable, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. Features may change over time.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. AI-generated insights are provided for guidance only and should be reviewed with pastoral judgment; they are not a substitute for professional advice. To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the twelve months preceding the claim, and we will not be liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Upon termination, your right to use the Service ends; we may delete associated data after a reasonable period.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and your continued use of the Service after changes take effect constitutes acceptance.
